When an injured plaintiff becomes incapacitated, no one has the legal authority to accept a settlement on their behalf, unless they are the agent under a power of attorney, or a duly appointed legal guardian under either Article 81 of the Mental Hygiene Law or Article 17-A of the Surrogate's Court Procedure Act.
